Visa time limits on foreign Ph.D. students and postdocs will harm U.S. science, experts warn

In mid-July, the Department of Homeland Security (DHS) announced a final rule that will fundamentally reshape the landscape of American academia. Under the new regulations, future international students and postdoctoral researchers will be allowed to stay in the U.S. for no more than four years on nonimmigrant visas. If their programs exceed this window—as the vast majority of doctoral programs do—they must apply for and receive a formal extension from DHS. While those already in the U.S. won’t need an extension if their training is set to conclude before September 2030, the shift represents a seismic change for the next generation of global talent considering the United States as a destination for advanced research.

The department has argued that the change, which takes effect September 15, is a necessary security measure to prevent the phenomenon of "forever students." DHS officials allege that some individuals manipulate the current system by perpetually enrolling in minor courses or shifting between programs simply to avoid leaving the U.S. and to circumvent the traditional immigration process. According to the DHS publication in the Federal Register, the agency identified more than 2,100 foreign students who entered the country between 2000 and 2010 and were still listed as active students as of April 2025. By implementing a fixed period of admission, the administration believes it can better monitor visa compliance and protect national security.

However, immigration experts, university administrators, and advocates for the scientific community warn that the stricter policy will inflict lasting damage on the nation’s scientific standing. The timing is particularly sensitive, as international researchers are the lifeblood of American innovation. Data from the National Science Foundation (NSF) shows that international students made up nearly a quarter of life science Ph.D. graduates and a staggering 59% of postdocs in 2023. These individuals are not just students; they are the primary workforce in the biomedical labs that develop vaccines, discover new cancer therapies, and advance the frontiers of genomic medicine.

The disconnect between the new policy and the reality of scientific training is stark. The average biomedical Ph.D. in the United States takes between five and six years to complete. Under the four-year cap, a majority of incoming foreign graduate students would be forced to navigate a complex, costly, and uncertain extension process midway through their research. Science is rarely a linear path; experiments fail, funding cycles shift, and peer-review processes for major publications can take years. By introducing a hard deadline, critics argue the government is treating scientific discovery like a factory assembly line rather than an intellectual pursuit.

The postdoctoral community faces similar hurdles. While the length of postdoctoral appointments is more variable than graduate training, NSF survey data indicate that about a fifth of postdocs are likely to have worked in that role for more than six years. These researchers are often the "engine room" of university labs, supervising younger students and managing long-term federal grants. "This rule puts the U.S. at risk of losing key individuals to global competitors," said Thomas Kimbis, CEO of the National Postdoctoral Association. "We need to make our environment attractive and competitive. This rule moves us in the wrong direction."

The "duration of status" policy was first implemented in 1979 during the Carter administration. At the time, the U.S. Immigration and Naturalization Service recognized that the previous system—which required annual extensions—was an administrative nightmare that provided no real security benefit while creating massive backlogs. The 1979 shift was intended to streamline the admission of international students, allowing them to remain in legal status as long as they were making "normal progress" toward their degree. This flexibility allowed the U.S. to dominate the global market for higher education for decades.

The Trump administration’s move to reverse this policy is viewed by many as an extension of a broader "America First" approach to immigration and labor. DHS Secretary Markwayne Mullin defended the decision, stating, "For nearly half a century, the outdated ‘duration of status’ system has compromised national security and created an environment ripe for immigration fraud." The administration contends that the lack of a fixed end date on visas makes it difficult for immigration officers to track individuals once they enter the country.

Yet, many in the legal field find this justification thin. Elizabeth Goss, a prominent immigration attorney in Boston, points out that the federal government already has robust tools to monitor this population. For over 20 years, the Student and Exchange Visitor Information System (SEVIS) has allowed DHS and the Department of State to track international students in real-time. Universities are required to update SEVIS if a student changes their major, moves to a new address, or fails to maintain a full course load. "These people are already the most regulated population of nonimmigrant visa holders in the country," Goss said. "I just think it’s an excuse to limit ultimately how many people are coming into the United States."

The administrative burden of the new rule cannot be overstated. When a draft version of the policy was posted for public comment last year, it garnered nearly 22,000 responses, the vast majority of which were critical. The University of California system, one of the world’s premier research engines, warned DHS that the department would be completely overwhelmed by the sheer volume of extension applications. One UC campus alone estimated that more than 4,500 students would need to apply for extensions every year. Katherine Newman, the UC system’s executive vice president for academic affairs, wrote that the inevitable backlogs and "opaque adjudication process" would deter the world’s most talented visitors from choosing the U.S.

The fear of a deterrent effect is supported by empirical data. A survey by the nonprofit NAFSA: Association of International Educators polled more than 1,000 students and postdocs. The results were telling: nearly half of the respondents said they would not have come to the U.S. if a fixed four-year limit had been in place when they applied. Prospective students also indicated a strong preference for the old system, with 67% saying they would likely enroll under "duration of status" compared to only 57% under a fixed-term system.

This policy shift also appears to contradict other administration goals. While the White House has expressed a desire to reduce the "administrative burden" on researchers to accelerate innovation, the new visa rules do the exact opposite. Bastien Aymon, external affairs chair of the Massachusetts Institute of Technology’s Graduate Student Council, noted that international students are already under immense pressure. "We’re already busy enough just focusing on science, and we don’t particularly enjoy having to spend time worrying about submitting forms and then talking to, potentially, lawyers," he said. "It’s obviously confusing and stressful."

There are already signs that the U.S. is losing its luster for international scholars. Factors such as rising visa fees, travel bans, and a perceived unwelcoming political climate have contributed to a cooling of interest. A survey by the Institute of International Education found that international graduate student enrollment dropped 12% last fall. While some DHS data suggests enrollment might be stabilizing, the long-term trend remains a point of concern for university leaders who rely on tuition and talent from abroad.

The administration’s perspective was perhaps most clearly articulated by Michael Kratsios, director of the Office of Science and Technology Policy (OSTP). In a report outlining the White House’s vision for American science, Kratsios argued that the U.S. has become dangerously dependent on foreign talent. He suggested that this reliance "sidelines American students," whom he described as an under-supported domestic talent pool. "At the same time, we train extraordinary global talent at enormous expense, only to lose this effort when foreign governments recruit them to build up their own technological enterprises," Kratsios wrote.

This "zero-sum" view of global talent is contested by many in academia. Andrew Read, Pennsylvania State University’s senior vice president for research, argues that the presence of international scholars is a "win-win" for the country. Even if some researchers return home, they often become lifelong collaborators with American scientists, extending U.S. influence and "soft power" globally. "We want to support the best talent in the world," Read said. "We’re concerned with anything that is jeopardizing that really important role that U.S. universities play for both America and for the world."

As the September 15 deadline approaches, the scientific community is bracing for a new era of uncertainty. Labs that rely on international Ph.D. candidates may find it harder to recruit, and the administrative offices of major universities are preparing for a wave of paperwork that could clog the immigration system for years. For a nation that has built its technological and medical supremacy on the contributions of immigrants—from Albert Einstein to the founders of Moderna—the end of "duration of status" marks a significant and controversial turning point in the history of American innovation.
